Legal Provisions
  1. The Protection of Civil Rights (PCR) Act 1955
    1. To prescribe punishment for preaching and practice of – “Untouchability” and for the enforcement of any disability arising from untouchability.
  2. The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities): POA Act, 1989
    1. The Act prohibits the commission of offences against members of the Scheduled Castes and Scheduled Tribes (SCs and STs) and establishes special courts for the trial of such offences and the rehabilitation of victims.
    2. The Act outlines actions (by non SCs and STs) against SCs or STs to be treated as offences.
    3. Forcing an SC or ST individual to vote or not vote for a particular candidate, Assaulting or sexual exploiting an SC or ST woman etc. are offences under the Act
  3. The Prohibition of Employment as Manual Scavengers and their Rehabilitation Act, 2013
    1. The Act prohibits the employment of manual scavengers, the manual cleaning of sewers and septic tanks without protective equipment, and the construction of insanitary latrines.
    2. It seeks to rehabilitate manual scavengers and provide for their alternative employment.
    3. The District Magistrate and the local authority shall be the implementing authorities.
    4. Each occupier of insanitary latrines shall be responsible for converting or demolishing the latrine at his own cost.  If he fails to do so, the local authority shall convert the latrine and recover the cost from him.

Scheduled Caste Welfare – Organisations
  • National Commission for Scheduled Castes (NCSC) – Refer Polity Book
  • National Commission for Safai Karamcharis
    • statutory body was established through National Commission for Safai Karamcharis Act, 1993
    • to promote and safeguard the interests and rights of Safai Karamcharis
    • The main objective of the National Commission for  Safai Karamcharis is to study, monitor and evaluate the implementation of the programmes and schemes relating to the social and economic rehabilitation of safai karamcharis and make recommendations to the Central Government for better coordination and implementation of schemes/programmes
  • National Safai Karamcharis Finance and Development Corporation (NSKFDC)
    • Wholly owned Govt. of India Undertaking under the Ministry of Social Justice & Empowerment (M/o SJ&E). It was set up in January 1997  as a Company “Not for Profit” under Section 25 of the Companies Act, 1956.
    • Operates as an Apex Corporation for the all round socio-economic upliftment of the Safai Karamcharis, Scavengers and their dependants throughout India.
  • National Scheduled Castes  Finance and Development Corporation (NSCFDC)
    • Promote prosperity among Scheduled Castes by improving flow of financial assistance and through skill development & other innovative initiatives.
    • Providing concessional finance for setting up of self-employment projects and skill-training grants to unemployed SC persons living below Double the Poverty Line.
